You see, I expected Toni Basil to be the one at the helm of the lawsuit, since my esteemed Shoutmouth co-worker TomZ pointed out, when the song first came out, how much the song sounded like "Mickey" by Toni Basil.
Tommy Dunbar, founder of the Rubinoos, filed his suit, naming Avril, Avril Lavigne Publishing, and some dude named Dr. Luke, who is her "songwriting partner."
Uh, wow. I kind of think he may have a case here:
If he aligned with Toni Basil, they'd have a slam dunk, since "Girlfriend" is really just a mix of both songs.
According to CBC, Avril Lavigne's manager, Terry McBride, said "the claim is baseless, noting that a musicologist he hired to study both tracks has deemed them completely different songs."
I'm no "musicologist," but let's face it... the choruses are basically the same, and changing "boyfriend" to "girlfriend" doesn't count. If it does, watch out for my new hit song, "Sophie in the Sky With Diamonds."
